Procedures

1) Is the LPR customer subject to sponsor deeming?

Follow the steps below to determine if sponsor deeming applies to a Lawful Permanent Resident (LPR):

Determine if the LPR is potentially eligible for full services.

  • If NO, STOP. Sponsor deeming does not apply when the LPR is only eligible for FES.

  • If YES, continue to step 2

Was the LPR status granted on or after December, 1997?

  • If NO, STOP. Sponsor deeming does not apply.

  • If YES, continue to step 3

Did the customer have Refugee or Asylee status before the LPR status?

  • If YES, STOP. Sponsor deeming does not apply.

  • If NO, the LPR is subject to sponsor deeming unless he or she meets an exemption.

 

 

2) Sponsor Deeming Calculation

When the customer is subject to sponsor deeming and does not meet an exemption (see B-D below), use the following steps to determine the amount of the sponsor’s income deemed to the customer.

Add the total gross income of the sponsor and the sponsor’s spouse (if living with the sponsor).

Determine the sponsor’s family size. Includes the following people in the family size when living with the sponsor:

  • The spouse of the sponsor

  • The sponsor’s dependent children

  • The dependent children of the sponsor’s spouse

Subtract 100% of the FPL for the sponsor’s family size from the total gross income from Step 1 to get the deemed income amount.

Only count the deemed income amount to the sponsored noncitizen customer.
