2) Determining if Alimony is an Allowed Deduction for MAGI

Follow the instructions below to determine how to treat alimony income for MAGI programs.

If the alimony deduction was not applied, would it affect eligibility for AHCCCS Medical Assistance or KidsCare premiums?

  • If YES, continue to step 2.

  • If NO, STOP. Process the case without the alimony deduction. A copy of the court order is not needed.

Request a copy of the most recent alimony court order.

Did the customer provide a copy of the most recent alimony court order by the RFI due date?

  • If YES, continue to step 4.

  • If NO, STOP. On the allowed deductions from income screen in HEAplus, select the checkbox next to “Court Order was not provided”. Process the case without the alimony deduction.

Is the most recent court order dated before 1/1/2019?

  • If YES, STOP. The customer qualifies for the income deduction. Review the questions on the allowed deductions from income screen and make sure all questions are answered correctly. Continue to process the case.

  • If NO, STOP. Submit a Policy Clarification Request (PCR) asking for a review of the court order to determine if the customer can get alimony deduction.
